Throughout the site, the terms “we”, “us” and “our” to refer to Fat Tomato.  We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools added to the current store shall also be subject to the Terms of Service.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit/debit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit/debit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided without express written permission by us.

SECTION 2 - EVENT BOOKINGS 

When booking an event on a Fat Tomato website, you agree to the following terms and conditions:

  • that you will inform us prior to booking of any medical condition or allergy of which we should be aware.

  • all bookings made are non-transferable and non-refundable, except when cancelled more than 30 days before the event – in this instance, the booking can be refunded or transferred to an alternative date free of charge.

  • that we reserve the right to refuse entry, in line with the Licensing Act 2003, to any customer displaying signs of intoxication or disorderly behaviour.

  • Although we make every effort to avoid changes to our events, we reserve the right to alter the instructor or change the event's date, time, or location. Where we cancel the event or alter the date, time, or location of the event, and you cannot attend, you will be offered an alternative event or a full refund.

  • Some of our courses, workshops, and events require a certain amount of people to attend. Occasionally, we might have to cancel or postpone an event. Bookers will be notified at least two weeks in advance and offered a suitable date in the future or a full refund. 

SECTION 3 - ONLINE SHOP

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Section 4 - gift cards

In buying a gift card, you agree to the following terms and conditions

  1. Gift cards are valid for 5 years from the date of purchase.

  2. Gift cards are non-transferable and are non-refundable.

  3. You can redeem your gift card through our website. You cannot use it in our honesty shop.

  4. You must enter the gift card code when prompted to use the voucher in the online shop.

  5. Our gift cards can be spent all at once or little-by-little on our website. If you have a balance left after applying the gift card value, you can use your card to pay the rest.

  6. Physical gift cards can be posted throughout the island of Ireland by standard post for an additional €7 per gift card. Please allow 2 to 5 working days for the gift voucher to be delivered.

  7. If you would like to send a physical gift card to someone living internationally, it costs €20 per gift card. Please allow 5 to 10 working days for the gift voucher to be delivered.

  8. Our printed gift cards are A5 in size and are presented in a beautiful kraft envelope.

SECTION 5 - WEBSITE CONTENT AND INTELLECTUAL PROPERTY RIGHTS

Fat Tomato is the owner or the licensee of all intellectual property rights in our website and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy or reproduce part or all of the contents of the website in any form including, without limitation, its incorporation into or store in any other website, electronic retrieval system, publication or other work (whether hard copy, electronic or other) without our express permission.

We may update our website and these terms and conditions from time to time, and may change the content at any time. We do not guarantee that our website or any content on it will be free from errors or omissions.

SECTION 6 - BRAND AND IDENTITY 

All assets on this website remain the property of Fat Tomato and are subject to copyright and trademark. No one has the permission to use our logo, photography, website copy or illustrations without written consent from an authorised person of Fat Tomato.
